Central Ohio day care operator accused of sexually abusing kids gets 30 days in plea deal
"COLUMBUS, Ohio - A day care owner convicted of abusing children will spend 30 days in jail.
Kimberly Hignite was operating an unlicensed day care in her Grove City home.
When the Sheriff's Office searched the home in May 2018, they say they found 24 children with one adult: Hignite's 71-year-old mother.
They say many of the children, between 7 months and 5 years old, were strapped into car seats, left unattended in separate rooms.
Monday in court the mothers of five of those children stood to face Hignite and tell her how her crimes impacted their children."

"Donald Trump's labor secretary, Alexander Acosta, has resigned following criticism of his handling of a 2008 plea deal with the disgraced financier Jeffrey Epstein, who is awaiting trial on charges of sex trafficking underage girls.
Trump announced the news on Friday with Acosta by his side at the White House. "Alex Acosta is a great secretary of labor," Trump said. "I hate to see this happen." He said he did not ask Acosta to leave the cabinet."

NJ judge says Eagle scout's sex assault of drunk girl is not real rape
"At a house party with about 30 pajama-wearing adolescents drinking alcohol, a 16-year-old boy led a staggering-drunk teenage girl into a hidden corner of the basement and sexually assaulted her while recording it on his phone, prosecutors said.
Afterward, investigators said, the boy sent at least seven of his friends a copy of the clip with the caption: "When your first time having sex is rape."
Prosecutors, calling the teen's actions "cruel" and "sophisticated and predatory" beyond his age, want him to face justice in adult court.
A Family Court judge, however, didn't think what happened to the girl was really rape and said prosecutors should have explained to the humiliated victim that pressing charges would ruin the life of her attacker — an Eagle scout with good grades from an "excellent school."
An appellate panel overturned Judge James Troiano's decision."

Officer avoids jail time in attempted unlawful sexual conduct case
"TUCSON – The Tucson Police Department officer accused of overlooking an arrest warrant in exchange for oral sex was sentenced to three years of probation in connection to the case Monday afternoon.
Back in January, Officer Richard Daniel was arrested for unlawful sexual conduct and tampering with physical evidence in connection to an incident that occurred at a midtown 7-Eleven on Jan. 13.
After further investigation, Daniel reportedly discovered that a woman involved had an outstanding warrant for her arrest. According to court documents, Daniel allegedly told a woman he would not call in a warrant for her arrest if she performed oral sex on him.
The TPD officer pleaded guilty to attempted unlawful sexual conduct as a police officer on May 2."

Then you read about the Texas doctor who went free after assaulting a patient while she was sedated. You note similarities. Then you read about the high school girl who reported her rape immediately, to no avail—police never even spoke to the alleged attackers. You tack one story like this onto the other, you thread them, and suddenly you have a string of anecdotes that, without much system or method, seems to describe an America disinclined to punish sexual assault. Man who raped 12-year-old awarded joint custody of her child
"A man who raped a 12-year-old has been awarded joint custody of her child despite being convicted of her rape and another sexual assault on a child.
The convicted rapist assaulted the girl nine years ago and she subsequently became pregnant.
A judge has given Christopher Mirasolo, 27, parenting time and joint legal custody of the eight-year-old boy after a paternity test found he was the father.
Since his conviction for the rape in 2008, Mirasolo, from Brown City, Michigan, has been convicted of another child sex assault, for which he served four years in prison."

Former Watertown City School District bus driver sentenced to probation for rape
"WATERTOWN — The former Watertown City School District bus driver who admitted in a plea deal in February to raping a 14-year-old girl was sentenced Thursday in Jefferson County Court.
Shane M. Piche, 26, was sentenced by Judge James P. McClusky to 10 years' probation, as expected, and will be registered as a Level 1 sex offender as a result of his guilty plea Feb. 21 to third-degree rape.
While the district attorney's office had requested a Level 2 designation, Judge McClusky said because Piche had no prior arrests and there was only one victim in this plea, Level 1 was more appropriate.
A Level 1 sex offender is considered to be at low risk of committing the crime again and is not included in online sex offender databases."

The 33-year-old Duluth man was sentenced to 10 years with eight months to serve in jail after pleading guilty to first-degree cruelty to children and interstate interference with custody Thursday afternoon. He received credit for the eight months he was held in the Gwinnett County Detention Center before receiving bond in February 2018. That means his prison time has already been accounted for and he will serve the remaining nine years and four months on probation and must register as a sex offender."

"A student found guilty of sexually assaulting a six-year-old girl for more than two years will face no punishment after being granted an absolute discharge.
Christopher Daniel, an 18-year-old dental student from Glasgow, denied carrying out numerous assaults on the girl while he was aged 15 to 17 and she was between six and eight.
He was granted the discharge by Sheriff Gerard Sinclair after being found guilty at Dumbarton sheriff court at the end of a three-day trial.
This means the teenager will not be placed on the sex offenders' register and the guilty verdict was not recorded as a conviction."

In a packed courtroom, Judge Ralph Strother of the 19th District Court accepted a deal prosecutors offered to Jacob Walter Anderson in October, allowing him to plead no contest to the third-degree felony charge of unlawful restraint, and receive deferred probation. In 2013, a woman, identified in local media as Laura, checked into Ben Taub Hospital in Houston. She was being treated for shortness of breath and wheezing; she was kept overnight and sedated.

Lyle Burgess, 79, was sentenced by San Joaquin County Superior Court Judge Ron Northup to either 90 days in an alternative-work program or in-home detention plus five years of informal probation. He does not have to register as a sex offender.

Rapist gets probation for attack on 13-year-old at Baptist church camp in Oklahoma
"SULPHUR — In an unusual plea deal, a Spencer man has been sentenced to 15 years on probation after pleading guilty to brutally raping and sodomizing a 13-year-old girl at Falls Creek church camp.
Benjamin Lawrence Petty, 36, tied rope around the girl's wrists, raped her and then threatened her with physical harm if she told anyone, according to the criminal charge. He was at the camp as a cook at the time of the 2016 offense.
Murray County Assistant District Attorney David Pyle, who negotiated the guilty plea, said Petty is "legally blind" and that was a major factor in his decision not to insist on prison time.
Petty was given the suspended sentence by District Judge Wallace Coppedge on Jan. 19 after entering a negotiated guilty plea to first-degree rape, forcible sodomy and rape by instrumentation. All three are felonies."

"A Walker man accused of murdering his girlfriend's convicted molester in 2015 did not testify in his own defense Wednesday, but a jury heard Jace Crehan tell a detective just days after the slaying that he strangled and stabbed Robert Noce Jr. because the criminal justice system had "failed" Brittany Monk and he didn't want her to suffer any longer.
Noce, 47, was killed inside his Zachary trailer 13 days after he pleaded "no contest" to sexually molesting Monk when she was a child. Noce was put on probation for five years. He was a former boyfriend of Monk's mother and raised Monk for about 10 years."

Dr. Donald Cline, 77, is accused of fathering at least eight children with different women who came to his office in the 1970s and '80s for fertility treatment.
It's believed that he could have more than 20 children, Fox 59 reports.
Cline, who is now retired, appeared in court on Thursday to plead guilty to lying to investigators. He wasn't charged with impregnating the women with his sperm because there is no state law against it."

"HUNTINGTON - In a case that has been lingering in the Cabell County court system for years, a Huntington man has been placed on probation in a case alleging he impregnated a girl who was later forced to get an abortion.
Cabell Circuit Judge Paul T. Farrell, honoring a plea deal reached between assistant prosecutor Kellie Neal and defense attorney Connor Robertson, placed Michael Joe Adkins, of Ona, on five years' probation and 50 years of supervision after his probation is completed.
Adkins had entered a Kennedy plea in September 2015 to incest with a young girl. A Kennedy plea allows a conviction without the defendant admitting guilt or explaining his role in a crime. He will also have to register as a sex offender and take specialized classes and therapy as part of the deal."

Father Kevin Gugliotta will serve 11½ to 23½ months in prison and must register as a sex offender, according to reports.

A Gwinnett County mother didn't tell police that her boyfriend sexually abused her 6-year-old daughter because of her "hectic work schedule," the district attorney's office said.
The boyfriend, Damylo Morrow, was convicted Thursday of sexual battery and acquitted of child molestation after a three-day trial.
The mother pleaded guilty to two counts of first-degree cruelty to children for failing to report the abuse and telling the child to lie about it, the district attorney's office said. She was sentenced to eight years probation under the First Offender Act and cannot have unsupervised contact with the child for the duration of her probation.
The AJC is withholding the identity of mother in this case in order to protect the identity of the child, who is a victim of sexual abuse."

"A Montgomery County judge that struck a child sex abuse conviction from a former high school teacher's criminal record, will also allow the teacher to remove his name from the state's sex offender registry.
Circuit Court Judge David A. Boynton on Sept. 15 provided former Albert Einstein High School teacher Richard Shemer the written consent needed to legally remove his name.
"Mr. Shemer is no longer required to register as a sex offender and shall be removed from the Sex Offender Registry list," Boynton's court order read.

" A Brooklyn judge sent a former NYCHA worker to prison for up to a decade Monday for sexually molesting three kids he cared for at a Williamsburg after-school program.
Nicholas Rodriguez pleaded guilty in July to first-degree criminal sex act and other charges for sexually assaulting children under the age of 10 between 2009 and 2011."

"A Delaware judge sentenced former Ravens cheerleader and fitness author Molly Shattuck on Friday to 48 weekends in a community corrections center for the sexual assault of a 15-year-old boy.
Shattuck, who pleaded guilty in June to a count of fourth-degree rape as part of an agreement with prosecutors, is to spend alternating weekends in a facility in Delaware for the next two years. She is required to register as a sex offender in Maryland and Delaware, and forbidden to be around anyone under the age of 18 other than her children."

Lemont man gets probation for child porn charges
A Lemont man charged in August with child pornography was sentenced by Centre County President Judge Thomas King Kistler to six years probation on May 29.
Alexander Park, 25, pleaded guilty to 10 felony counts of possessing child pornography before Kistler in January. Fifteen other counts of the same charge as well as a felony charge of criminal use of a communications facility were dropped, according to court documents.
